INFORMATION AND CONSENT TO PROCESSING OF PERSONAL DATA

In compliance with Legislative Decree 196/03 and subsequent amendments, art. 13 Reg. UE 2016/679 (so called GDPR), the underwritten company Thermore (Far East) Ltd, Room 1705, Concordia Plaza, 1 Science Museum Road, Tsim Sha Tsui East, Kowloon, Hong Kong, data controller, provides information regarding processing of personal data.

Source of data and purposes of processing
The personal data in our possession are directly gathered from individual clients and/or collaborators or via agents and representatives in the event of special offers and/or from current or possible future suppliers. Data can also be gathered from third parties, such as, by way of an example, data acquired from external companies for marketing information purposes or market surveys or from other clients or suppliers of ours.
The personal data are processed as part of our company’s normal activities for purposes connected with and instrumental to management of contract relationships; for purposes linked to obligations imposed by law, by regulations or by EC rules, as well as by measures issued by authorities legally enabled to do so or by supervisory or control bodies; for purposes for our activity which the data subject may give or refuse or withdraw consent, namely management, statistics, sales, operations, marketing and promotion, market surveys.

Data processing methods
The data will be processed using tools that guarantee the security and privacy of same and in addition to manual tools, automated tools may also be used (both computerised and IT) for memorising, managing and transmitting the data.
We must also inform you that your personal data will be processed in compliance with Legislative Decree 196/03 and subsequent amendments, and Reg. UE 2016/679 (so called GDPR), which also states that the data must be:
– processed in a lawful correct manner;
– gathered and recorded for defined, explicit, legitimate purposes;
– exact and if necessary updated;
– pertinent, complete and not exceeding the processing formalities.

Categories of third parties to whom the data may be communicated
We inform you that the personal data you provide or which we acquire during our contract relationship with you may be communicated to the following third parties, whose functions are closely linked or instrumental to our activity, functions that must therefore be deemed fundamental for our company’s business:

a) financial administration, social security and assistance bodies if necessary, Public Security Forces;
b) transporters or other organisations working in the supply services;
c) professional anti-fraud and debt-recovery companies or bodies;
d) banks and credit institutes as part of our company’s finance management;
e) insurance companies;
f) auditors and administration, tax and contract consultants;
g) our employees;
h) other companies from our group;
i) IT companies.

The personal data you provide may also be communicated to other companies in our group for coordination of management activity, including those in EU and non-EU countries. If personal data are transferred out of the EU, we will ensure that appropriate measures are taken to protect personal data in accordance with applicable data protection law. This may be in the form of EU standard contractual clauses or binding corporate rules. Your data will not however be diffused publicly.

Data retention period
Personal data will be processed for varying periods of time depending on the different purposes of processing; in any case, only for the period of time strictly necessary to achieve the purposes for which the data were collected and processed.

Rights of the data subject
Finally, we must inform you that by law citizens may exercise specific rights. In detail, the data subject have the right: (art. 15 GDPR) to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and other information; (art. 16 GDPR) to obtain from the controller without undue delay the rectification of inaccurate personal data; (art. 17 GDPR) to obtain from the controller the erasure of personal data concerning him or her without undue delay; (art. 18 GDPR) to obtain from the controller restriction of processing under certain circumstances; (art. 20 GDPR) to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format under certain circumstances; (art. 21 GDPR) to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions; (art. 22 GPDR) under certain circumstances, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her; (art. 7 GDPR) to withdraw his or her consent at any time, bearing in mind that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal; (art. 77 GDPR) to lodge a complaint with a supervisory authority.

Consequences of refusal to provide personal data
We must also inform you that your “right to refuse to answer” when compiling the information may

In compliance with Legislative Decree 196/03 and subsequent amendments, art. 13 Reg. UE 2016/679 (so called GDPR), the underwritten company Thermore S.p.A. (P. IVA 01717150138) with headquarter in via Santa Lucia n. 1 (23848) Oggiono (LC) Italy, data controller, provides information regarding processing of personal data.

Type and source of data processed
As part of the Contest, reserved for individuals 18 years of age or older, Thermore S.p.A. will process the following personal data:
– first name, last name, date of birth, country of residence, and email address, provided by you, from 26/01/2025 to 16/02/2025, when visiting the Thermore installation at the Mottolino ski resort in Livigno;
– address, fiscal code, copy of ID card, provided by you by email, in case you turn out to be the winner of the prize.

Purpose of processing and legal basis
The personal data are processed for purposes:
– of managing the Contest, awarding and delivering the prize, under art. 6 par. 1 lett. (b) GDPR (contractual obligation);
– fulfilling legal obligations (in particular, those related to prize events, DPR 430/2001), under art. 6 par. 1 lett. (c) GDPR (legal obligation);
– enforce or defend a right of Thermore S.p.A. in the appropriate courts and tribunals, under art. 6 par. 1 lett. (f) GDPR (legitimate interest);
– of receiving marketing communications (newsletters, email, sms, etc) from Thermore S.p.A., regarding products, services, events, new collections, etc, under art. 6 par. 1 lett. (a) GDPR (consent).

Data retention period
Personal data will be processed and stored for varying periods of time depending on the different purposes of processing:
– for the purposes of managing the Contest, awarding and delivering the prize, until 30/11/2025;
– for the purposes of fulfilling legal obligations, for the period required by law;
– for the purposes of enforce or defend a right of Thermore S.p.A., for the period of 10 years from the end of the contest;
– for the purposes of marketing communications, until your consent is withdrawn.

Consequences of refusal to provide personal data
The provision of personal data is:
– mandatory in order to participate to the contest; failure to provide data will result in the impossibility to participate in the Contest;
– facultative in order to receive marketing communications; failure to provide data will result in the impossibility to receive marketing communications.

Rights of the data subject
